Could I obtain Severance if Scotiabank is not willing to accommodate me to another Campus Location due to Family Hardship ( Daycare and Pre school). Requested accommodation but management declined and sent form to HRHi, my employer is pushing us back to office 3x per week (Tue/Wed/Thu). My employment contract states that I work remotely 50-75%, and visits to the office are occasional & flexible (which this new ask is not). They have not asked me to sign a new/revised contract, at least not yet. I have only received an formal email from my manager, who was directed by HR to do so for every employee within a certain distance from the office. I would like to push back, but have an ESA clause in my contract which concerns me re: severance. I would like to know if the ESA still applies under these circumstances. I have only been there for 4 years and if I understand correctly, would only receive 4 weeks severance, which is not enough. If this is in fact the case, I will have to back down and comply with the request. Thank youI work from home and have been for 4 years, the company I work for told us we have to get updated refurbished desk top computers with 2 large monitors . When I exchanged my computer equipment I had to go to the to the exchange location at my expense , as did other employees. I had to travel by uber as I could not carry the equipment on TTC and it would not be safe. I travelled by uber which cost me $150.00 and was not paid for the time it took to go there and back. Is this in compliance with labour laws in Ontario ?If I worked at a company for ten years making 54,000 a year how much severance should I expect and how long should my benefits continue. Is the following termination clause ambiguous? (d) Your employment may be terminated by the Company at any time without cause upon the Company providing you with written notice of termination or payments in lieu of notice or a combination of both, at the Company’s discretion in accordance with your entitlement to reasonable notice and benefi t continuation under the common law. Such notice/payments will be inclusive of your entitlements to notice of termination and severance pay under the applicable employment or labour standards legislation, as may be amended. You will be obliged to diligently search for alternative employment during any period of notice or payments in lieu of notice. Any income you earn from alternative employment will be taken into account in mitigation of your entitlements from the Company under this provision, but in no event will you receive less than your termination/severance entitlements, including any continuation of benefi ts, under the applicable employment or labour standards legislation, as may be amended. As a condition precedent to any payments pursuant to Subsection 8 (c) (but provided that the Company has complied with its obligations under this agreement and except for the Company’s obligations pursuant to the minimum provisions of the applicable employment or labour standards legislation, as may be amended), you agree to execute and deliver the Company’s standard Separation Agreement and Release, which contains a full and fi nal release from all actions or claims in connection with the termination of your employment in favour of the Company, and all of its respective officers, directors, trustees, shareholders, employees, attorneys, insurers and agents. Does the following para prevent me from pursuing any future claims other than what the company offers e.g three weeks severance on 1 year contract terminated after 8 months? You further agree that upon any termination of your employment pursuant to this agreement by the Company in compliance with this agreement or upon any termination of your employment under this agreement by you, you will have no action, cause of action, claim or demand against the Company or any other person as a consequence of such termination.
