Working as a pressure truck driver in the oil patch. Required to load and deliver different chemicals to various locations. On one of my delivery days I was told I loaded the wrong chemical and delivered to the wrong site. Two days later I was brought into the office by the dispatcher and the owner. I knew what the meeting was about already and as I sat down I asked was I fired. The owner sat back in his chair and said with an attitude like that you are. So in saying that I got up packed my stuff up went out to the shop shook everbodys told them I was fired of course they were all shocked when I told them and left.
Went to apply for EI benefits filled out the form where is said why I was applying and I put down fired but they put on my ROE that I quit. Went to the labor board they ruled that I indeed was fired and didnt quit. They finally paid my severance. Now i would like to see if I have a wrongful dismissal case.
Thank you for your inquiry. Unfortunately, since a claim was commenced through the Ministry of Labour, it is very unlikely that you would be able to proceed with any sort of court action against your former employer. Therefore, it is unlikely that we would be able to assist with this situation. If you would like to schedule a formal consultation to discuss further, please contact us at the number below.
