I have been working at my company for almost 5 years. And they are now planning to move the company downtown by this year end. Do we as employees have any recourse ?

Thank you for your question.

A forced transfer can, in some circumstances, constitute a constructive dismissal. A constructive dismissal would entitle you to your full severance. However, it is context specific. Factors that need to be considered include your employment agreement, the distance you would be traveling, and the cost that it would impose. In certain cases, if you leave your employment after a forced transfer, it could be considered a voluntary resignation with no severance entitlement. It is very important to get legal advice before making any decisions, and to do so as soon as possible.

Therefore, before taking any action, it is strongly recommended that you contact us at the number below, so that we can properly evaluate the strength of your case given all the circumstances.
