Ask your question and an employment lawyer in Ontario, BC or Alberta will answer in minutes
I worked as a truck driver for a construction company for almost 7 years straight and just received a lay off with only 1 days notice. He said shortage of work but no one else got laid off. My dump truck has not been legal for the road for some time so I refused to drive anymore until it was fixed. Then I was just given days off all the time until a lay off. Am I owed termination pay from not being given any notice?
I did not get a termination letter yet but I did ask for one stating if this is temporary or permanent as I was told returning doesnt look good. I wasnt offered any money at all.
I am sorry to hear about the employment issues that you are having to deal with.
In Ontario, the vast majority of employees who are terminated are entitled to be paid notice upon termination. There are very few exceptions to this.
The problem as highlighted in your question is that it is currently unclear if your employment has ended. The employer has muddied the waters to allow it to avoid its legal responsibilities.
We can help fix this and get you clarity and your lawful entitlements. Do not sign anything yet, as that could have a negative impact on your entitlements or rely on information from the employer. Contact us, and a member of our intake team will be able to guide you through the next steps.
