I work for an American company here in Ontario. When hired I was paid salary plus commission. In the offer it stated I was to be available 24/7 during the week and work one weekend a month. A few years ago the company changed our pay to salary plus merits. There was no mention about nights and weekends in that offer. Then a month ago they changed my title from Territory Manager to Territory Representative. Do I still have to work nights and weekends without being compensated?

Generally, employers are not permitted to make an employee work without being compensated, except for an extremely limited set of circumstances. It is also concerning to read that your title was unilaterally changed by your employer, in a manner that appears to be a demotion in title.

As the circumstances you describe create potentially time sensitive legal issues, we encourage you to seek legal advice as soon as possible. We strongly encourage you to contact us to set up a consultation with one of our employment lawyers who can fully review your circumstances, provide you with guidance and advice regarding your workplace rights, and assist you in navigating the situation in a manner that best suits your goals.
