I voluntarily resigned from my former eßmployer in September 2025. After my departure, I received an HR email in October asking me to elect a payout date for a 2025 short-term incentive plan (STIP) award (~$12-14k), subject to board approval. I was not advised during offboarding that resignation timing or non-completion of a year-end evaluation (which I was instructed by senior management not to complete) would affect eligibility. HR later advised that voluntary departing employees are not eligible. Seeking general advice on whether post-termination incentive communications has any legal significance.

This will depend on the wording of the Short-Term Incentive Plan. While the post-termination communication may be important, your entitlement to the award is also a contractual question which will require a review of the terms of the STIP.

Please contact our firm if you would like a review of the STIP terms and your potential entitlement to the bonus/award.
