I'm unable to continue working as a software developer due to an (as yet) undiagnosed mental deterioration. I'm concerned that I'm going to fall into a crack where I can't claim disability because it's hard to prove I can't work and I'm fired for being unable to work. Or maybe it will be blown off as "old age" rather than a disability.
I've worked as a software developer for decades and have been with my employer (major tech firm) for more than 10 years. My ability to program declined slowly and then suddenly. I have an appt with my doctor seeking treatment/diagnosis but don't know what to do about work in the meantime. It's awkward to keep going to the office but not be able to be productive. Seek STD or LTD leave?
As a first step, you should definitely apply for STD or LTD leave. If you do not qualify, you may be able to pursue what is known as a frustration of contract claim (on the basis of a disability) against the company which would allow you to receive your minimum severance entitlements under the provincial law.
