I am a senior director in a corporation. I get an annual bonus. It’s a percentage of my salary plus how the company is doing. I have been with the company 30 years. I am 62 almost 63. I get that my package would be 2 years. But I would like to know if they have to give me my bonus and shares they give every year for those 2 years severance.
My name is David Vaughan and I'm an employment lawyer with Samfiru Tumarkin. Under the common law, an employee is entitled to all forms of compensation they would have earned during the severance period. However, this presumption can be rebutted if there is an enforceable contract that removes these common law entitlements. Please contact our firm to discuss the matter in more detail and determine whether you would be entitled to your bonus and shares as part of a severance package.
