My name is Rosa Ayotte and I have been off work since November 2018 as I had a workplace injury on August 3, 2017.
I was on WCB for wage replacement but in May of 2025, WCB decided that I was fit for work. No where did I get approval for work from my doctor. To this date, she is continuing to advise I am unable to work in any capacity both physically and mentally. I am currently working with an appeals advisor from the Advisor Office for Alberta Workers Compensation.
What I am looking for currently is for the following:
I received a call from SunLife, who is my Benefits provider for my employer, saying that my benefits were terminated as of May 1, 2026. To my knowledge I was still employed with my date of accident employer. Towards the end of May, I find out that my employment with my Employer ended on April 30, 2022 following the closure of the Calgary branch. I did not know about this. They said due to an administrative oversight, my benefits were not terminated at that time as they should have been. But then turn around in the next paragraph and say that during my WCB leave they continued to provide access to my health and medical benefits through Sun Life in support of my recovery. I call BS on this. How can you say it should have ended in 2022 and then say it was out of curiosity that they continued with them. But now as of May 1, 2026 then have ended?
I was never legally advised that I was terminated. I have not received any notice of termination or even that the branch office was closed. I still have lots of personal items in that office.
Hi Rosa, sorry you are going through this. You may have a claim for wrongful dismissal given that your employer apparently terminated your employment without cause in April 2022. One issue that may arise is the limitation period for making the claim. Claims must be brought within 2 years from the time that you knew or ought to have known that you had a claim. Your argument would be that you were unaware of the termination until approximately May 1, 2026 when your benefits ended. However, more information will be needed in order to provide a complete analysis on whether you might have a wrongful dismissal claim and whether pursuing such a claim would be viable. I would suggest that you reach out to our intake team at https://stlawyers.ca/labour-employment-law-employees/ to speak further with them and to schedule a consult.
