There is a now a policy at work saying that we must return to the office for at least 2 days a week, however in our last team meeting one of the managers mentioned exceptions to this rule and one of them being that this rule doesnt apply to you if you were already working remotely prior to covid 19 and its more so for the employees who transitioned to remote work due to covid 19 pandemic. So I wrote an email to my director mentioning that and that i have been working remotely for several years prior to covid 19, as part of my role when i accepted this position and the the remote work status that came with it. This arrangement has been in place since late 2017. Since then that manager has left and i transitioned to other leaders twice but still have been working mostly remotely unless my director was coming to the office or if i had the need to meet and work with someone at the office. So i wrote some of that to my current manager who is asking now if i have any relevant documentation which i dont but im thinking if they have attendance records couldnt they confirm that i havent been in the office regularly since 2017 amd so the exception should apply. Concern is now its 2 days a week but i can see them moving it to 3, 4 or even 5 days a week.
If you were working remotely since 2017 then that is a term of your employment and if the force you back into the office it would be considered a constructive dismissal.
