Myself and my partner have been working as live in night responders at an independent living home where we are required to live on site and be on call from 12am-8am 7 days per week and required to respond to alarms, etc immediately, as well as additional duties such as setting up breakfast and some janitorial on the weekend. We each get paid a salary of 22k per year for the 7 day per week position, and out of that comes 900 each per month for ‘rent’ on the place we live in on site. After all is said and done, our take home pay for the 56 hours per week equals about 7.80 per hour. We gave our notice and when they posted our position they are now splitting it into two and paying our same wage to someone for 5 days per week while someone else will do the weekends, which is what made me start thinking about our compensation. We also have never been paid extra for stats in the time we have been here. In looking into the ESA it seems we should at the very least be paid minimum wage take home and the ‘rent’ on the suite we are required to live in should be above and beyond that? I want to be sure I’m interpreting that correctly? Thank you so much in advance.

You should have been paid minimum wage during your employment. Further, you should have either been paid extra or provided time off during statutory holidays. As such you may have a claim for unpaid wages. Unpaid wages claims are dealt with the by the Employment Standards Branch. However, the employer can charge for room and board, but that should have been clearly outlined in your employment contract.
