Ask your question and an employment lawyer in Ontario, BC or Alberta will answer in minutes
This is not a termination question but whether a change to the accrual vacation policy is legal. This applied to all DXC.com non-unionized Canadian employees. I am not a Union employee but there are Unions paid by DXC Technology (my employer). My employer DXC.com has informed all Canadian employees that our accrued vacation must be used by 31-Dec-2025 with only 5 days available for carry over with any days above 5 being lost with no payout then as of 1-Jan-2026 the new Flex Vacation Benefit commences (not accrual based) with a vacation allowance of no more that 10 workdays, followed by 20 workdays back before the next vacation request can be submitted. Any vacation greater than 10 will require permission from someone higher up in the company, i.e. not the immediate manager. This new flex vacation policy is based on the minimum Provincial statutory compliance of Ontario being 3 weeks after 5 yrs. I have 25 years of service and accrue 6 weeks per year. My question is, is this change legal? (I spoke to Victoria and she provided me with this link).
Any changes to how you accrue and carry over your vacation requires proper advance notice. The advance notice is not sufficient if you don't have enough time to use your accrued vacation before it "expires", in which case the company should pay out the vacation days you are not able to use before the end of the year. A consultation may be required to discuss next steps, should the company refuse to work with you on an agreeable solution.
