I am currently on mental health leave as a result of a severely toxic work environment created by my temporary manager. HR initially acknowledged the inappropriate and harmful behaviour I experienced, including bullying, berating, and repeated instances of miscommunication for which I was unfairly blamed. They also advised me to take leave and assured me that, since this reporting structure was only temporary due to organizational changes, they would support me in finding a new role. My original employment contract was with a different manager who was later terminated, and I never signed or agreed to remain under this temporary manager. Despite my documented concerns and the evidence I provided—including texts and emails showing the manager’s conduct—HR is now pressuring me to return to the same environment following internal HR turnover. Over my 25-year career I have consistently been an outstanding performer, and I have never experienced treatment like this at any workplace.

What can I do?

Hello,

We would need more specifics of what you have been the victim of, such as emails or contemporaneous notes. However, if you were the victim of harassment or if your manager created a toxic work environment, that may amount to a constructive dismissal.

In such a case, you would leave your job and pursue your severance. Severance can be up to two years of your total compensation or more. The first thing you must do is decide if you are willing to leave this job and pursue your severance. If you are, then you should immediately speak with on of our employment lawyers to develop a path forward.
