Ask your question and an employment lawyer in Ontario, BC or Alberta will answer in minutes
I have been on long-term disability through my employer for coming up to 2 years this July. I was recently told by my internal medicine specialist that I absolutely cannot return to work right now, as that would make me sicker. I relayed this information to my employer, and she sent me an email back stating "As your leave reaches the two-year mark, and in light of the medical recommendation that you not return to work in the foreseeable future, we will take this update as formal confirmation of your resignation from your role, effective June 30th, 2025." So, I'm curious as to if this is correct... as I didn't resign, but rather I was told I cannot return to work due to illness. Is there anything I should be doing about this? She said I would continue my LTD claim with the insurance through work, but would lose my extended health benefits and medication coverage.
When an employee is on a medical leave, an employer has several obligations at law, including those flowing from Ontario's Employment Standards Act, and Ontario's Human Rights Code. We strongly encourage you to contact our firm to schedule a consultation with one of our employment lawyers.
