Is it legal for an employer to reduce my hours because I cannot perform other duties due to recognized, documented and accepted physical limitations (age related)? They are doing this to the three of us in our area even though there is still work available to do. The Supervisor informed us verbally tonight the manager told him to send us home early and our hours were cut to 3 hours per day. It is common knowledge the manager is under pressure to cut costs. Is he allowed to do this?
An employer cannot discriminate against an employee because of a physical disability, and doing so may be the basis for a human rights complaint. An employer is also required to accommodate an individual's disability up to the point of undue hardship.
Further, you may have a contractual entitlement to a certain number of hours per day or week, and by cutting your hours, your employer may have breached your employment contract.
