I was laid off from my job in May 2025. Before signing the separation package, I consulted with a few lawyers and ultimately decided it was in my best interest to accept the package rather than pursue legal action, as the terms were fairly reasonable.

According to the agreement, I was supposed to receive all payments—including severance, vacation pay, and prorated bonus—by June 15. However, it's now been a month, and I still haven’t received my vacation pay. I’ve been following up with my former employer, and while they keep assuring me that the payment is being processed, nothing has been resolved.

Given that this delay is in violation of the separation agreement, is there anything I can do to enforce the terms and ensure timely payment?

Your options for addressing the situation will depend on the amount of vacation pay outstanding. Settlement agreements and the violation of those agreements are dealt with by the Courts and which court body you use depends on the amount at stake.

Any claim regarding the delayed in payment would likely only result in a nominal recovery. However, if your employer does not adhere to the terms of the agreement and fails to provide you with your outstanding vacation pay you may have a claim and could move to enforce the terms of the settlement agreement.
