Hired remotely in 2022 during COVID, continued remote after restrictions lifted. Now, nonprofit employer demands me and two colleagues switch to in-office 5 days/week with 4 weeks’ notice, while most of 600-person company stays hybrid or remote.
Hello,
Unless you signed an employment contract allowing your employer to recall you to full-time in-office work, your employer cannot do so without your consent.
Requiring you to work from the office may amount to a constructive dismissal, in which case you could treat it as a termination and pursue your severance. Right now, the first decision you must make is are you ready to leave your job over this change and pursue your severance. To get a better sense of how much severance you may be owed, visit severancepaycalculator.com
If you do decide that you are prepared to leave, make sure to speak to one of our employment lawyers at Samfiru Tumarkin so that we may guide and advise your course of action.
