Under federal law and the Canadian Human Rights Act, what is considered a “legal obligation” to a family member (not a minor) who you are a caregiver for? Do you need to have an ACTIVE power of attorney?

Family Status is a protected ground of discrimination in most Human Rights legislation across the country. Family status is generally considered as "being in a parent-child relationship"; this also includes people caring for aging parents or relatives with disabilities. You do not need an active power of attorney to ask for accommodations due to family status. However, most human rights claims are brought under provincial legislation, as only federally regulated entities are subject to the Canadian Human Rights Act.
