My employer likely misclassifies me as an independent contractor. Will I have to reimburse my employer for the GST I collected over my years of employment when the courts/CRA make the determination I have been misclassified? Will the employer have to reimburse me for the years of CPP payments I had to make?
I am a tenured worker employed under the terms and conditions of a collective agreement. I had the exact same job in Ontario and that employer was forced to change the workers' status to employee after an investigation. I do not have control over my work environment or schedule, can't choose a substitute, bear no financial risk, work mainly for the same employer at the same place of business, and while I provide my own tool (I had it since I was a teenager) my previous employer provided me with a T2200 which covered those expenses.

Unfortunately we can not provide financial advice relating to the tax consequences of misclassification. If you are currently employed under a collective agreement, unfortunately a private lawyer would likely be unable to assist you, you would have to file a grievance through your union.
