-complicated modified RTW program x25+ weeks with pauses due to re-injury
-employer refuses to continue, forced sick leave b/c of length of time despite medical documentation advising need for more time, expected full recovery and that sick leave would not be good for recovery
-employer says not breeching Human Rights code b/c it is modified RTW and not permanent accom and that undue hardship does not apply
-30 week LTD eligibility period starts Apr 7, was advised to complete application

I am sorry to hear about the injury and everything that you are going through. An employer refusing to allow you to return to work with accommodations is very much punching you when you are already down.

A refusal to allow you to return to work on modified duties could be considered a constructive dismissal and/or discrimination, however it is very context specific, so more information would be required.

Sharing medical details and information is not something that can be done in this question and answer format, so an actual consultation would be required. Please feel free to contact us.
