Ask your question and an employment lawyer in Ontario, BC or Alberta will answer in minutes
Is the following clause in my offer letter enforceable? The two locations are ~60km apart and is a big change to my working arrangement. No relocation assistance is provided.
“This position will initially be based out of the Markham, Ontario location and your day to day work locations are
subject to change from time to time as determined by the Company, and in fact changes are anticipated, including,
for example, to a Durham offices work location and on site work locations at Darlington Nuclear Generating Station.”
This clause very likely allows the employer to change your work location from Markham to somewhere in Durham or at Darlington. To resist this, you would need to establish that you cannot accept the change due to a reason protected by human rights legislation (i.e. childcare obligations, medical disability, etc.).
