Hi, I’m awaiting a decision from my company ‘s third party who handles accommodation requests (relating to RTO), is it within my rights to follow the doctors recommendations/request for the days in office they mention vs what the company has asked of everyone? (In the interim until a decision is officially made/communicated). Or, legally should I have to follow what the policy states (despite having a Dr. note) until a decision is made? Thanks.
Employers have an obligation to accommodate employees with disabilities to the point of undue hardship. More information is required about your requested accommodation, the supporting documentation from your doctor, and your employer’s interim stance with respect to your requested accommodation while the request is processed by the third-party. We strongly encourage you to contact us to set up a consultation with one of our employment lawyers, who can fully review your circumstances, provide you with guidance and advice regarding your workplace rights, and assist you in navigating the situation in a manner that best suits your goals.
