Ask your question and an employment lawyer in Ontario, BC or Alberta will answer in minutes
I applied for EI in Ontario about 4.5 months ago while being misclassified. CRA finally ruled me as an employee yesterday. Assuming my former employer has received the ruling letter, when should I follow up with them for my record of employment if it all, and what should I do if they refuse to issue one.
If CRA has approved your E.I. application they may have your record of employment on file after requesting one from your previous employer. You can check your Online CRA account. You can request one from your employer, but the record of employment is largely a document for E.I. and tax purposes. If they refuse you would need to show damages, which may be in the form of denied E.I. - Another issue I see here is that you may have a claim for severance as an employee if you had been misclassified as a contractor.
