Add Comment Question: I was employed by an Agency and was converted to a permanent staff after 9 months by my current employer. I am now facing a mass layoff and my employer did not include the period before the direct employment. My contract states that the period before my employment will not be considered for any reason including termination and I understand that, however, the company had been including periods from that time in disciplinary correspondence but not the severance package and I want to know if this is a cause to review the package. I also recently had been on a medical leave and currently have an accomodation as there are still some issues medically, can this be considered for extension of benefits as well? Answer: If you signed a new contract of employment at the time you began with the employer after the initial 9-month period, the first 9-month period likely would not be included in your severance calculation. Your recent medical leave would also not be the basis for having your benefits extended, although it may raise some issues if you could establish that your termination was connected to your recent medical leave.
