Add Comment Question: I have been working for this company for 31 years and in 2019 I went off work for disability. I am now on Permanent long term. I received a letter that the company wants to cut my medical (medication, therapy, dental, vision, etc.) come this July. We have received notice saying something along the lines that since we have went with a new company starting from this date on ALL employees going forward on Longterm disability will only be able to collect 2 years of medical benefits (medication, therapy, dental, etc). They said they are allowed to do this because they are with a new company and since they switched over I fall under new rules. Longterm was always paid by company as long as your off till you return. Is this legal for them to do? I need my benefits for medication, therapy, dental, etc... And they also said they can cut their part of the pension that they contribute. But I am not allow to contribute because I am not on payroll I am on PLTD. Answer: Thank you for your question. Generally, an employer does not have to continue extended health and dental benefits during an extended medical leave. In the absence of a contractual right to benefits during a medical leave, a company is generally legally entitled to discontinue those benefits.
