Add Comment Question: I work at an occupational therapist at an Ontario hospital "A" which has recently merged with another hospital "B". I am a non-union employee. The two pay scales of the former A and B have now been made into a new scale which has 7 steps. Top earning employees in my position from hospital A have been placed at step 5 on the new scale. The top earners in my position from hospital B have been placed on step 6. All of us now work for the same corporation, same job but this pay discrepancy exists. I am wondering if this is unlawful. Answer: There can be pay discrepancies between employees in similar positions, so long as the differences are not based on discriminatory factors such as gender, race, etc. Importantly, employers cannot make a major, negative change to your employment without your consent, and so if this merger has resulted in a reduction in your pay, you would have recourse against the company.
