Add Comment Question: I am a technical support representative at a call center, resolving issues with home internet, tv, and home phone. I was recently laid off and am now being recalled to a debt collection position for a credit card company. I have Autism Level 1 and the new position would create challenges for me with regard to reciprocal conversation. I explained this to my employer and was told that they consider the positions to be comparable and that failing to attend the start of the position on this coming August 17th would be taken as a voluntary resignation. There are differences in communication between the two positions. I have medical documentation of my disability. My diagnosis documents are not currently on file with them but I have on occasions expressed to my supervisor a request for accommodations but was denied. The request was made through teams so I don't have written documentation of it at the moment. Answer: It seems that your employer may be failing to accommodate your disability, which may be the basis for a human rights complaint. However, you want to make sure that you’ve documented your disability with your employer, as well as given specific request for accommodation supported by medical documents. In the event that your employer deemed that you have voluntarily resigned, this would make a good basis for making a human rights complaint. It also may be the basis for wrongful dismissal damages, depend, depending on the nature of your contract.
