Add Comment Question: Employment standards officer ordered my former employer to pay an arbitrary amount of 3 weeks pay for lost wages from a reprisal termination instead of all lost wages which would have been 12 months. Ive discovered this is a common error made by ESO's. Am I correct? Answer: If you made a complaint through the mechanism of the Employment Standards Act and were given an award as compensation for lost wages arising from the reprisal you are entitled to either 1) compensation for damages being an amount equal to the employee's weekly earnings multiplied by the number of weeks it took or should have taken (whichever is less) the employee to find a new job; or 2) The employee's termination pay entitlement under the Act with vacation pay. You should have been awarded the greater of the two options above, and I am unclear how your award of damages may have been calculated.
