Add Comment Question: I just recently quit my long term employer of over a decade. I had two weeks of pre booked vacation time in the calendar, so I gave them 4 weeks of notice and worked a week, took week off, repeated. During this 4 week period, I trained 3 new employees at their asking and thought I was leaving on great terms. For my final paycheck they deducted 6.5days of "unaccrued" vacation and short paid me by few thousand dollars. Are they in the right, or do I have an issue worth fighting for? Answer: My name is David Vaughan and I'm an employment lawyer with Samfiru Tumarkin. Your employer is not permitted to deduct unearned vacation pay from your final wages, unless you have agreed to this in writing. If they did not obtain this permission in writing, you should contact the Ministry of Labour.
