Add Comment Question: I currently have 46 earned vacation days and my manager told me she wants me to use 41 days before year end (she said she would only approve 5 carryover days), or they would be forfeited and I’ll lose them. Is this allowed? Answer: Under Alberta's Employment Standards Code, you can't lose the minimum vacation the law guarantees (2 weeks a year, or 3 weeks after 5 years), and your employer can't take it away through a policy. Most of your 46 days are probably extra days under your contract or company policy, and those can usually be forfeited under a carryover limit if the rule was clearly communicated in writing and you had a real chance to use the days (this would depend on your contract or what has been communicated to you through company policy). Your employer can schedule your vacation with at least 2 weeks' written notice, but requiring 41 days off before year end may not be realistic, which weakens any forfeiture.
