Add Comment Question: I am planning to accept an offer for a job starting in the new year. I am currently pregnant and plan to start maternity leave in my current position before starting the new job (I cannot start the new job earlier), which will go beyond the current specified start date for the new position. Is there any human rights protection or other laws that protect me from having the offer rescinded due to taking maternity leave before the new position starts, or are there amendments I should request for my offer letter? Answer: Hello, In BC, Alberta, and Ontario you have protection from discrimination due to pregnancy through Human Rights legislation. Therefore, your employer must accommodate your maternity leave to the point of undue hardship. Therefore, your current and new employer must accommodate your maternity leave unless it would cause them undue hardship.
