Add Comment Question: I have worked for the same company for 37 years, I am currently on sick leave and have a medical certificate, I have been on sick leave for over a month. Every year we receive a year-end bonus, my employer deducted 95 hours from my bonus for what they say was unauthorized leave. I didn't think I needed premission from my employer to take medical leave. Since they have deducted this money could this be looked at as constructive dismissal. Answer: Hello, The reduction in your bonus is surprising, given that it would have been based on the past year's performance, when you were not on sick leave. That said, the reduction in the bonus likely amount to about 2 weeks of pay which, on its own, would not amount to a constructive dismissal. However, if your employer continues on this course of action, it may indicate that they no longer wish to employ you, which is a constrictive dismissal. We have often seen a constrictive dismissal arise when an employee takes, or attempts to return from, a medical leave. We can help you navigate these turbulent waters.
