I need legal advice regarding severance calculation. I was a college professor for 12 years working 40-60 hours weekly. In the last 12 weeks, my employer reduced my hours to 9 hours per week, then terminated me. They calculated my severance based on these reduced hours rather than my standard 12-year work pattern. The severance letter didn't specify this calculation method. Looking to challenge this calculation as it significantly reduces my entitled severance amount. They laid off a few other employees and did the same and we are all unhappy. We were given 7 days to review the severance letter with a lawyer, which was not enough and made us sign a release. The employee acted in bad faith and felt like it was a shady tactic to skim us from a proper severance pay.

Thank you for your question. Unfortunately, if you have already signed a Release, it is unlikely that you will be able to pursue your former employer for further severance. That said, if you would like to discuss your situation in more detail, please give us a call at the number below to speak with one of our experienced employment lawyers.
