My employer abolished my management position of 5+ yrs and I chose not to continue with the company in a different roll as it was not suited to my objective for my career path, is this constructive dismissal?

If the employer attempted to put you in a position that was not comparable to your previous role and you chose not to accept it because the position was not fundamentally comparable in nature to your previous position, this is likely a constructive dismissal scenario wherein your termination entitlements would be triggered. I highly recommend that you contact our office to schedule a consult with one of out employment lawyers so we can better review your matter (and namely, the nature of the change in your position) to determine whether there has been a constructive termination of your employment, and if so, to assess your entitlements.
