I am seasonal in the lawn care industry, my hours for the last 2 years was 10-6 and now they are claiming it's company policy that its now 11-7, even though my manager tried to tell us that the government changed the calling rules which is not correct and that does not sit well with me at all being the top sales rep in Canada for this organization Answer: Hello, Employers have some latitude to change the conditions of employment. However, if they make a substantial change to a fundamental component of your employment, such as wages, title, or working conditions, they would need you to consent to the change. What is a fundamental component of your employment will vary from job to job. For instance, if you have other obligations that conflict with this new schedule such as a second job or childcare obligations, then your 10-6 shift may be a fundamental component of your employment. If it is and your employer continues to insist on changing your shift, you may be entitled to quit and still pursue your severance as though you had been terminated. This is called a constructive dismissal. You first have to decide if you are ready to quit your job and pursue your severance over this shift change. You only have a short period of time to make the decision. If you do decide to leave, please reach out to us first so that we may help you navigate through the termination of your employment.
