I’ve been with the company for 15 years as a senior accounts Payable specialist doing full accounting and leadership for all four locations for the company. I’m 42 1/2 years old, with no employment contract. I was forced to go on a temporary lay off even though there was no written notice prior to the temp lay off and I’ve told them, that I don’t agree and don’t accept this temp lay off. I did not sign anything. Over the course of those 3 months I was seeking your legal counsel on what I should do. I was told to wait out the temp period of 90 days. On the 89th day I was called into the office assuming I was getting my recall when I was instead being told that I was being terminated without cause and that there is no longer any need for the position as it’s being eliminated. I am the only Accounts payable for the company so how can they suddenly just eliminate the position and the duties to go along with them? They offered me 8 weeks in lieu of notice and only 20 weeks severance with no health benefits. They want to pay me this in 7 payments. There is a now a policy at work saying that we must return to the office for at least 2 days a week, however in our last team meeting one of the managers mentioned exceptions to this rule and one of them being that this rule doesnt apply to you if you were already working remotely prior to covid 19 and its more so for the employees who transitioned to remote work due to covid 19 pandemic. So I wrote an email to my director mentioning that and that i have been working remotely for several years prior to covid 19, as part of my role when i accepted this position and the the remote work status that came with it. This arrangement has been in place since late 2017. Since then that manager has left and i transitioned to other leaders twice but still have been working mostly remotely unless my director was coming to the office or if i had the need to meet and work with someone at the office. So i wrote some of that to my current manager who is asking now if i have any relevant documentation which i dont but im thinking if they have attendance records couldnt they confirm that i havent been in the office regularly since 2017 amd so the exception should apply. Concern is now its 2 days a week but i can see them moving it to 3, 4 or even 5 days a week.I have asked to return to work after a long period on LTD. I was given a two day heath assessment 2 months ago. I have contacted my employer about when I return and was told the assessment takes a long time. I've heard nothing more. Do I have a case?I have been off on long LTD for 2 years for mental illness. I was let go after having a medical assistant done for my employer. Two weeks after sending in the form I was fired. In my contact there is a clause for two year termination. I had started the talk about returning to work.I have worked for my company for almost 20 years. I am 56 years old. The company assets are being sold and the company is closing. I have been told that they will give me 8 weeks severance (based on their small payroll). Is this true? Previous Next Page 108 of 1631
