I have been temp laid off since April 1st, 2020. The employer has brought each employee back to work, except myself and 1 other. I am told they don't have the sales income to bring me back yet. They are still paying my extended benefits. My signed contract states that if I am terminated without cause, I'm entitled to 3 weeks per full year work up to 6 months. I have been told that because I did not sign a form regarding temp lay offs from my employer, i should be entitled to back pay from april 1st to today. Is this true?

If you wish you may decide to treat this as a termination by way of a constructive dismissal. A temporary layoff that is not agreed to in advance is a termination by law.
