I was on maternity leave and went back to work on October 1st. I had my performance review recently and was told my bonus amount would only be based on the time I have been back at work (October-November). Is this legal? Should the employee be penalized for the time they were away on maternity leave?

If your bonus is based on performance over a period of time in which you were not working, they would not have to take that time into consideration.
