I was laid off March 27th I have not heard from my employer since I left that day. Do I need too send an email or phone call before I move to pursue my severance. I no the rules have changed under ESA. Are the rules still the same under common law?

Thank you for your question.

The rules are the same under the common law and based on what you have described you would have a viable case for constructive dismissal. Please contact us at the number below for a consultation at your earliest opportunity. Note that your entitlements expire two years from the date of your notice of layoff.
