I am currently laid off for my job and seen that there is a amendment to employment
standards I do not think that my employer has any intention of bringing me back. My 13 weeks is up end of June when he he would either have to terminate or bring me back we do not have benifits. Can you shed any light on this for me.

Thank you for your question.

Despite the amendment to the Employment Standards Act, you may still have the right to bring a claim for constructive dismissal under the common law for your full entitlements.

Please contact us if you would like to have a discussion about that. Kindly note that your ability to file a claim for constructive dismissal expires two years from the date of your notice of termination/layoff.
