I am a full time employee layed off after 11 years work. Working for a construction company, across several construction sites. I am employed and paid strictly from one employer, I was hired as full-time, not on a contract basis.
My question is: am I entitled to notice and severance pay for termination layoff??
I contacted the employment standards branch of BC, and the staff said there is an exception to that law, which states an employee of a construction company that works on multiple construction sites is not entitled to notice or severance.
They said the employer is not obligated to provide notice or severance.
I told the staff I am not self employed or contracted, and work strictly for 1 employer. Fthey said they are 0 percent certain the exception applies in my case, and my employer is not obligated to provide notice or severance.
Is this true? seems odd to me to have this exception that would effect millions of trades workers in BC.
While construction workers are not entitled to termination pay under employment standards legislation in BC, you would still be owed common law termination pay, which is generally much greater.
