This is a follow up question from a previous answer. Thank you for your time and advice in the previous question. If upon return to my job and am offered a comparable position and If the comparable position dose not include the commission or bonuses that I had with the previous placement, does this constitute a constructive dismissal?

Thank you for your question.

You may have a right to claim wrongful dismissal in those circumstances, depending on the amount of commissions and bonuses and depending how long they have been in place, so I recommend you contact us below for a consultation as soon as possible. Kindly note that your limitation period expires two years from the date your cause of action first arose.
