Hello, can a company that has filed bankruptcy but still operating to liquidate for another month deny an employee their accumulated vacation pay....isint that money earned and owed?

Thank you for your question. Generally, in a bankruptcy situation, it is not a question of entitlement. An employee would be entitled to accrued but unpaid earnings and vacation pay, along with severance pay. However, the issue is that in a bankruptcy situation, the Company may not have the ability to pay. In most cases, an employee would not get their full entitlements, if they get any payments at all.
