I have been with a company for 12 1/2 years, it was sold and new owner took all 50 employees on and we all kept our seniority . we are in our second month and the new owner asked if I was ready to retire I told him I intended to work for another 2 to 3 years,I am in a management position, they approached me later said that the wanted me to retire the wanted to get a younger person in my position they needed young blood, to change the culture they offered me a $20,000.00 buy out, which I refused they then brought it up to $30,000.00. What should I do, there is no issue with my performance according to them, the then offered me a position as assistant manager of my department.

Thank you for your question. My name is Jon Pinkus and I am an employment lawyer with Samfiru Tumarkin LLP.

The question will be whether the amount they are offering to you is an adequate severance package. We can discuss what is appropriate over a short consultation, which I can offer to you for free.

We can also talk about your potential entitlement to compensation for breach of your human rights, given that there appears to be age discrimination behind the decision to end your employment.

Please contact me at your convenience at jon.pinkus@stlawyers.ca and we can arrange a time to speak.
