Add Comment Question: Hello. I worked at a retail chain as part-time sales associate for 3.5 years (September 2016 - June 30th 2020). Laid off due to covid store closing. After several months they decided not to renew lease and store location will close. While packing up store I met the manager from another location looking for new employees. Had to apply online as new candidate and fill our paperwork as new employee. Several days later received termination letter and severance offer from company about store closing. I also received part-time employment offer from the other store location. According to the new manager I am listed in the system as a rehire and not a transfer. If I accept new offer can the company rescind my severance offer and identify me as 'transferred' instead of 'terminated' ? If yes, is there a wait time before I can accept new offer without having to return severance? Thanks in advance. Answer: Thank you for your questions. As the company terminated your employment, you are owed your minimum statutory termination entitlements regardless of the new employment offer. In order to advise about the interplay between your former employment, the severance package being offered, and your new employment, we would need more information from you and we would need to review the relevant documentation. I therefore recommend that you call us at the number below to schedule a consultation with a lawyer in order for us to provide you with comprehensive legal advice.
